    How to Go on Vacation from a Job in Dubai

    Vacation is an important aspect of the employment relationship between employer and employee, providing an opportunity to rest, recuperate and devote time to personal life.     How to take a vacation after working in Dubai

    What types of vacation are there? 

    Annual leave

    The most important type of vacation for all residents of Dubai is the annual vacation. Staff with a minimum tenure of six months have the opportunity to receive vacation in the amount of two days for each month worked. Also, employees with longer company tenure than a year are entitled to leave with pay, the duration of leave is 30 days per year.

    Part-time employees are entitled to vacation time proportional to the hours they have actually worked (excluding days off), as outlined in their employment contract.

    Employers must grant leave and also have the right to set a start date and divide the leave into no more than two periods. The employer is required to notify the employee of their leave dates at least one month beforehand.

    The employee must receive payment for the remaining days of annual leave upon dismissal, together with final payment in the event of termination of leave early. In this case, payment will be calculated solely on the basic salary. 

    In addition, the employee has the right to take additional leaves without pay for any period, for example, 14 days a year. As a rule, you can take leave at your own expense at any time; by agreement with your employer, you will be given unpaid leave. You may take unpaid leave for family reasons, childbirth, or the illness of a child under fourteen.

    Sick leave

    In accordance with UAE labor law, every employee is entitled to take up to 90 days of sick leave annually, but only after completing the probationary period. These 90 days can be taken consecutively or in separate intervals, wage payments are structured as follows:

    • Full payment for the initial 15 days
    • Half payment for the subsequent 30 days.
    • No payment for the remaining 45 days.

    During the probation period, the employee can take sick leave or unpaid leave. However, more and more often, employers accommodate their employees and pay for time off even during the probationary period and deduct it from the salary if the employee does not complete the probationary period. 

    An employee with an illness or injury not related to production is required to report his illness or injury to the employer within two days. The employer can request the employee to undergo a medical examination to verify if there is a disease or injury.

    For diseases that are a direct consequence of an employee’s violation of production discipline, for example, consumption of alcohol or drugs, paid sick leave is not provided; only leave without pay is possible (additional leave without pay).

    Maternity leave 

    Pregnant employees are entitled to take time off, which they can take before and after giving birth. The vacation period is 60 days. Such leave is paid according to the following scheme:

    • 45 calendar days – full payment
    • 15 calendar days – half payment.

    The employer is required to grant the employee maternity leave upon her request at any time starting from the last day of the month preceding the month of birth, as evidenced by a certificate from a medical institution. 

    Leave requests must include certification. Apart from the standard maternity leave mentioned earlier, an employee can take an extra 45 days off without pay if she suffers from a pregnancy-related illness or childbirth complications that prevent her from resuming work. The illness must be verified by a medical certificate from an authorized medical facility. These vacation days may be consecutive or intermittent.

    In case of a child’s illness or disability, a working woman can take an additional paid leave of 30 days. This leave can be extended for another 30 days without pay. The child’s condition must be verified by a medical certificate from the appropriate medical authority, institution, which allows for leave (short-term leave). 

    Upon returning to work, the employee has the right to one or two additional breaks per day for breastfeeding her child. The duration of two breaks should not exceed one hour.

    Time off for Hajj and Umrah (pilgrimage)

    Staff may receive unpaid leave for Hajj pilgrimage. Vacation time must not exceed 30 days and can only be granted once during the period of employment with the company.

    The UAE labor laws do not contain any provisions entitling an employee to Umrah leave. If an employee requests leave for Umrah, the employer must agree and deduct it from the employee’s annual paid leave or consider leave without pay (administrative leave). 

    Leave for family reasons 

    Employees are entitled to paid bereavement leave of five days for bereavement leave including three days for the loss of a spouse, parent, child, sibling, grandchild, or grandparent. An application for time off is in the same form as an application for personal leave or annual paid leave.

    Study leave

    An employee who has worked for his employer for more than 2 years is entitled to 10 days of leave per year to take exams at one of the educational institutions approved by the emirate.

All these holidays and time off are important elements of the labor relationship, providing employees with the opportunity to rest, attend to their own health and that of their loved ones, as well as fulfill religious obligations.
